YCWA and Cordua lawsuits resolved, paving way for a future of collaboration and partnership

 

Yuba County Water Agency and Cordua Irrigation District are beginning a new chapter in the story of their relationship, having moved to one of collaboration and partnership, with the finalization of a recent settlement agreement. Both entities today exchanged settlement checks, resolving several long-standing disagreements, including two lawsuits.

“Just as important as resolving old disputes, this settlement agreement provides a foundation for future cooperation and collaboration between YCWA and Cordua,” said YCWA Chairman Brent Hastey.

The Water Supply and Water Quality Act of 2018 is a citizen’s initiative water bond that will appear on the November 2018 statewide California ballot. It will invest $8.877 billion dollars in California water infrastructure, including key categories like: safe drinking water, Sustainable Groundwater Management (SGMA) implementation, watershed restoration, fish and wildlife habitat conservation, infrastructure repair, and many other important water management programs.

California Water Board Lacks Jurisdiction to Curtail Water Use by Senior Water Rights Holders

The State Water Resources Control Board exceeded its jurisdictional authority under Water Code section 1052 when it issued curtailment notices to pre-1914 and riparian water rights holders, a Santa Clara County Superior Court judge decided Wednesday. The decision addresses a number of consolidated legal challenges to Board actions taken within Central California watersheds during the State’s recent and lengthy drought.

The court also concluded that the curtailment notices at issue violated the petitioners’ due process rights because they were issued “without first providing water users with an opportunity to challenge the findings upon which they were based.”

Four years ago, California voters directed the government to update our state water system by passing Proposition 1, a $7 billion water bond that included clear guidelines for investing $2.7 billion in new reservoirs.

Voters expected billions of gallons of water to be added to our surface storage system. Sadly, with a dry start towinter and another drought looming, the state hasn’t spent a dime on the new storage it promised.

About the Supervisors

History of Nevada County

Nevada County, California is one of the most historic and scenic areas of our state. It is a rural county comprising 978 square miles in northern California, with a population of approximately 99,000. The three incorporated cities are Grass Valley, Nevada City and Town of Truckee. Most of the population (65,000) lives in the unincorporated areas. The Grass Valley/Nevada City area in the west and the

 Truckee area in the east are separated by approximately 45 miles of National Forest and the Donner Summit mountain pass at 7,000 feet elevation.

Gold Rush

Prior to the Gold Rush, there were estimated to be about 4,000 Northern Maidu or Nisenan Indians inhabiting the area. Our modern history begins in 1848, when discovery of gold in California brought the first white settlers to Penn Valley. People of all nationalities came to work the mines.

The first wagons to cross the Sierra Nevada that opened the Truckee River route of the California trail came through Nevada County. The County was the site of the infamous Donner tragedy as well as being the center of the northern mines during the Gold Rush. Portions of the first transcontinental railroad and the first transcontinental automobile road are located within the county. Famous stage personalities, writers, politicians, and industrialists emanated from or found homes in the County. More recently, Nevada County’s high tech firms, outstanding schools, rich artistic community and cultural attractions, and scenic natural resources make it a desirable location for residents and visitors alike.

Incorporation

The County of Nevada was incorporated on April 25, 1851. The first County Supervisors served in 1856. For a complete list of all the Supervisors who have served Nevada County, view Board Member History (PDF).
